The In’s and Out’s of Local Law 196

What are the requirements of Local Law 196?

Local Law 196 of 2017 requires NYC workers on jobsites that must designate a Construction Superintendent, Site Safety Coordinator or Site Safety Manager to receive 30 hours of site safety training. By December 1, 2019, workers need to have 30 hours of site safety training. An additional 10 hours of training are required by September 1, 2020. 

Supervisors will need 62 hours of training by December 1, 2019. If workers are seeking a Limited Site Safety Training Card, they may defer their 8-Hour Chapter 33 training until after December 1st and take 4-Hours of General Electives and 4-Hours of Specialized Electives instead. 

December 1, 2019 Deadline for Workers

To meet the December 1, 2019 deadline and receive a Limited SST Card, workers must complete 30 hours of safety training. There are 3 ways that the training can be completed.

Option 1:

OSHA 30-Hour Class

Option 2:

OSHA 10-Hour Class with 20 hours of additional training

Option 3:

100-Hour training program approved by the the NYC Department of Buildings

Acceptable Proof of Training

To meet the deadline, an OSHA 30 Card or a Limited SST Card serves as acceptable proof that a worker has the required training. 

December 1, 2019 Deadline for Supervisors

Supervisors need 62 hours of training by December 1, 2019. The courses that supervisors need to complete by December 1st include:

  • OSHA 30-Hour Class
  • 8-Hour Fall Prevention
  • 8-Hour Chapter 33 (SSM Renewal)
  • 4-Hour Supported Scaffold User & Refresher
  • 2-Hour Site Safety Plan
  • 2-Hour Tool Box Talks
  • 2-Hour Pre-Task Safety Meetings
  • 2-Hour General Electives
  • 2-Hour Specialized Electives
  • 2-Hour Drug and Alcohol Awareness

What About Previously Completed Training?

Training received within the prior five years of applying for an SST Card, including a Limited SST Card, SST Card or Supervisor SST Card can be applied toward the requirements for receiving the card. Applicants who completed the training beyond five years may complete Prior Experience training, which includes 4-Hour Fall Prevention and 4-Hour Supported Scaffold User and Refresher, to receive credit for such training.

Can I Defer the 8-Hour Chapter 33 Training? 

Workers seeking a Limited SST Card may defer their 8-Hour Chapter 33 (Site Safety Manager Renewal) training until after December 1, 2019. Instead of taking the 8-Hour Chapter 33 (Site Safety Manager Renewal) by December 1, 2019, such workers may instead take 4-Hours of General Electives and 4-Hours of Specialized Electives.

What are Course Equivalents? 

If you have taken a Department-approved course, like the 40-Hour Site Safety Manager or 16-Hour Rigging Worker courses, you may be eligible to receive credit towards your SST training requirement. Please review the SST course topics and the Department-approved course equivalents table.

What are the Types of SST Cards?

Temporary SST Card

Issued to new entries into the workforce that have completed a 10-hour OSHA Course and will allow workers to begin work in NYC. This card expires after 6 months giving the worker enough time to complete the additional training needed to receive a limited or Full SST card.

Worker “Limited” SST Card

Required by December 1, 2019 – Issued to individuals who have completed 30 total hours of training specified by the department of buildings. This card will allow workers to work in NYC until August 31st, 2020, after which they will be required to have a “Full SST Card”.

Supervisor SST Card 

Required by December 1, 2019 – Issued to individuals who have completed a total of 62 hours of training specified by the department of buildings. This card will allow supervisors to work in NYC. This card expires 5 years after it has been issued and may be renewed if 16 hours of training by the Department of Buildings is completed before the date of expiration.

Worker “Full” STT Card 

By September 1, 2020 – Issued to individuals who have completed 40 total hours of training specified by the Department of Buildings. This card will allow workers to work in NYC. This card expires 5 years after it has been issued and may be renewed if 8 hours of training specified by the Department of Buildings is completed before the date of expiration.

Local Law 196 Dates to Remember 

  • October 16, 2017 – This is the date the legislation took effect and is relevant to online training.
  • March 1, 2018 – This is the date by which at least 10 hours of SST training was required for all workers/supervisors.
  • September 1, 2019 – DOB reserved the right to extend the 12/1/19 date to 6/1/2020.
  • December 1, 2019 – This is the date by which 30 hours of SST training is required for the worker and worker Limited SST Card will be required for all workers.
    • This is the date by which a 62 hours of SST training is required for supervisors and a supervisor SST Card will be required.
    • This is the date by which a Temporary SST Card will be required for new entrants to the industry.
  • September 1, 2020 – This is the date by which 40 hours of SST training is required by the worker and a (final) SST Card will be required for all workers.
